Conditions of e-order environment

Conditions of e-order environment
1. General
1.1 The conditions of the e-order environment (hereinafter: Conditions) concern the conditions for using the online ordering environment (hereinafter: E-environment) of AS Eesti Post (hereinafter: POST). If a person who wishes to use the E-environment (hereinafter: the User) registers himself or herself as a user of the E-environment or uses the E-environment, it means that he or she agrees to the Conditions and undertakes to perform them.

1.3 All rights to the content of the service shall belong to POST.

2. Definitions
2.1 Registered user – the user of the E-environment who has registered himself or herself in the E-environment and who has a user account granted by POST.
2.2 Subscriber – a person who has submitted an order in the E-environment.
2.3 Recipient – a person to whom POST sends the products purchased through the E-environment: periodical publications and philatelic products.
2.4 Order – an application submitted by the Subscriber to POST in the E-environment for the purchase of products, which is the basis for the settlement of accounts with the Subscriber and the delivery of products to the Recipient.
2.5 Address of the Order (hereinafter: Address) – the destination/place of delivery of the products specified in the Order.
2.6 Amount of the Order – the cost of the Order comprising the cost of the products to be purchased, the cost of additional services and the fees related to the execution of the Order, or the amount to be transferred by the User to the advance payment account.
2.7 Periodical publication (hereinafter: Publication) – a printed matter ordered by the subscriber and handed over by the publisher to POST for periodical delivery at least four (4) times a year, and with a weight of less than 600 grams. (By a separate agreement, the publisher may give a quarterly published Publication to POST, with a maximum weight of less than 700 grams, for delivery to the recipients.)
2.8 Publisher – Owner of the Publication.
2.9 Products – products ordered by the User through the E-environment.
2.10 Philatelic product – a stamp, first day cover (FDC), postal stationery, special cancellation, maximum card, year set, souvenir folder.
2.11 Philatelic standing order – an application submitted by the Subscriber to POST in the E-environment for the periodic purchase of philatelic products on the basis of an advance payment paid by the Subscriber to POST.
2.12 P.O. Box – a box in the possession of the recipient for the delivery of the postal product.

3. User registration and use of personal data
3.1 To become a registered user, one is required to fill in a registration form and determine a user name and password for oneself.
3.2 The user accounts of the E-environment are confidential and shall not be disclosed to any third parties (except for circumstances prescribed by legislation).
3.3 The data submitted by the User upon registration shall be entered in the client register of POST and shall be used to ensure the quality of the services provided by POST or to forward the advertising information related to the services provided by POST. The compulsory data for a private person are the given name, surname, user name and password, and phone number or e-mail address. The compulsory data for a legal person are the given name and surname of its representative, the name of the organisation, user name and password, and phone number or e-mail address.
3.4 By registering, the User shall grant consent to POST to the use of his or her data in a manner specified in the Conditions.
3.5 By acceptance of the conditions, the registered User shall grant POST the right to use his or her data in electronic direct mail.

4. Rights, liability and obligations of the User
4.1 The User has the right to use the E-environment in accordance with the Conditions and applicable legislation, inter alia, to submit Orders through the E-environment, receive information, submit enquiries, change the data supplied upon registering himself or herself as the User, etc.
4.2 The User has the right to demand the closing of his or her user account by sending a corresponding notice to the customer service centre of POST (phone 1661, Mon-Sat 9 a.m.-6 p.m. (except for national holidays), info@post.ee).
4.3 The User has the right to send complaints concerning the use of the E-environment to the client service centre of POST (phone 1661, Mon-Sat 9 a.m.-6 p.m. (except for national holidays), info@post.ee).
4.4 The User shall be liable for using the entire E-environment through the user name and password of his or her user account and for compliance with the Conditions when doing so. The User undertakes not to share their password with any third party.
4.5 The User shall be liable for the accuracy of the data of the Orders and enquiries entered in the E-environment.
4.6 The User shall be liable for any acts made by the authorised person or persons in the E-environment as a result of which POST incorrectly carried out the Order (sent products to a wrong address, etc) or the execution of the Order by POST proved to be impossible.
4.7 The User undertakes only to use the E-environment for the purposes that are in compliance with legislation and good practice.
4.8 The User shall be fully liable for any damage caused to POST, other Users, or third parties through the use of the E-environment contrary to the Conditions, legislation, or good practice.

5. Rights, liability, and obligations of POST
5.1 POST has the right, without prior notice, to limit the possibilities of using the E-environment for the purposes of preventing technical failures or repairing any failures present, while striving to ensure that such limitations would have minimum scope and duration. POST shall notify the User of any limitations on the use of the Environment at the first possibility on its website at www.post.ee.
5.2 POST shall reply to the notifications of the User specified in clause 4.2 no later than within ten (10) working days.
5.3 POST undertakes not to forward the data of the User to any third parties.
5.4 POST shall reserve the right to forward the data concerning the User should the data be forwarded to a person who shall process the data for the performance of the obligation provided by law or to a person who is legally entitled thereto.
5.5 POST shall not be liable for the correctness of the data entered by the User in the E-environment.
5.6 POST has the right to close the user account by notifying the registered User thereof if POST has identified repeated violation of the Conditions of the E-environment by the holder of the User Account or the use of the E-environment in a manner that is contrary to the applicable legislation.
5.7 POST has the right to limit access to the E-environment for computers from which POST has identified acts directed against the information system of the E-environment.
5.8 POST has the right to make changes in the E-environment at any time without giving prior notice to the User.
5.9 POST has the right to unilaterally change the Conditions without the obligation to notify the User thereof by email or through the E-environment. POST shall give the corresponding information to the User on the website of POST www.post.ee.
5.10 POST shall not be liable for any damage that may ensue to the User, incl. late delivery of the ordered Products, due to inability to use the E-environment because of any technical problems. Upon a delay in delivery of the Products for more than 30 days, POST shall notify the User thereof through the communication channel of which the User has informed POST.
5.11 POST has no right to deliver anything else instead of the subscribed product or not to deliver the product.

6. Ordering in the e-environment
6.1 Upon submission of the Order in the E-environment, the User shall fill in the compulsory information fields required for submission of the Order.
6.2 To submit the orders, it is required to give the contact information of the Subscriber, which for a natural person are: given name, surname, address, and phone number or e-mail address; for a legal person: name of the organisation, registry code, address, and phone number or e-mail address.
6.3 If the recipient of the Service and the Subscriber are different persons, the Subscriber shall submit the data specified in clause 6.2 with regard to both of them.
6.4 The Order of the User shall be deemed submitted by a confirmation thereof by the User in the E-environment by which the User agrees to the Conditions.
6.5 POST shall confirm the reception of each Order from the User in the E-environment. The receipt of the Order constitutes the information on acceptance of the Order, but does not imply prompt execution of the Order.
6.6 POST shall commence execution of the Order after the amount of the Order has been fully credited to the bank account of POST, as of that moment the contract for purchase of the Product is deemed to be concluded between the User and POST.
6.7 The order amount may be paid by the Subscriber in the E-environment upon making the Order.

7. Ordering of periodical publications
7.1 The User may order a Publication chosen by him or her at the price prescribed and on the conditions fixed by the publisher.
7.2 The User may order the Publication chosen by him or her to the address specified by the User for a period fixed by the publisher.
7.3 POST shall calculate the order amounts for Publications based on the price for ordering the Publication established and communicated to POST by the publisher as well as other ordering conditions for the Publication established by the publisher.
7.4 On the basis of orders received in the E-environment, POST shall deliver the Publication to the recipient as follows:
7.4.1 in regard to Publications that are published once a week or more frequently:
7.4.1.1 If the order amount is received by POST before Thursday of a particular week, the Publication shall be delivered to the recipient as of Monday of the week following the receipt of the order amount.
7.4.1.2 If the order amount is received by POST as of Thursday of a particular week, the Publication shall be delivered to the Recipient as of Monday of the second week following the receipt of the order amount.
7.4.2 in regard to Publications that are published less frequently than once a week:
7.4.2.1 If the order amount is received by POST on or before the 15th day of a particular month, the Publication shall be delivered to the recipient during the month following the receipt of the order amount.
7.4.2.2 If the order amount is received by POST after the 15th day of a particular month, POST shall deliver the Publication to the recipient during the second month following the receipt of the order amount.
7.5 The User has the right to send complaints concerning the delivery of the Publication and the Publication itself to the customer service centre of POST (phone 1661, Mon-Sat 9 a.m.-6 p.m. (except for national holidays), info@post.ee).
7.6 POST undertakes to receive and resolve all complaints of the Subscriber.
7.7 POST has the right not to execute the Order if the Order sent by the User contains erroneous (incomplete) or deficient information concerning the address of the Recipient. The User shall be informed of the erroneous information by the communication channel given by the User.
7.8 The Subscriber shall have the right to cancel, suspend the Order, and change the address specified in the Order. To cancel, suspend the Order, or change the address, the Subscriber shall send a relevant application to a post office of POST.

8. Ordering of philatelic products
8.1 The registered user can purchase philatelic products in the E-environment as a single order and make a standing order for philatelic products.
8.2 Upon submitting the Order for a single order, the User shall choose the philatelic products to be purchased and the manner of delivery thereof.
8.3 The order amount of a single order comprises the cost of the purchased products and a handling fee. The amount of the handling fee depends on the manner of delivery of products, which the User can choose upon making the Order.
8.4 A single order of the philatelic product shall enter into force as of the time when the order amount is credited to the bank account of POST.
8.5 The time period for execution of the Order, i.e. for delivery of the philatelic product to the recipient shall be 5 working days as of entry into force of the Order. If the Order cannot be executed within 5 working days, the Subscriber shall be notified thereof through the communication channel given upon submission of the Order.
8.6 Upon making a standing order, the User shall complete an order form specifying the desired philatelic products, the beginning date of the order, and the advance payment.
8.7 The order amount of a standing order comprises the advance amount chosen by the Subscriber upon making the Order.
8.8 The standing order shall enter into force after the order amount has been credited to the bank account of POST.
8.9 The philatelic products desired by the Subscriber shall be sent to the recipient in accordance with the conditions and choices determined by the Subscriber upon submission of a standing order. The User shall pay for the philatelic products in accordance with the invoice submitted by POST, and the amount specified in it shall be set off by POST by the amount transferred to the advance payment account of the User. A standing order shall expire upon exhaustion of the advance payment unless the Subscribed has transferred an additional advance payment to his or her user account.
8.10 The registered user who has a valid standing order may see the balance of the advance payment in the E-environment.
8.11 To terminate the standing order, the User shall send to POST at the e-mail address specified in clause 4.2 of the Conditions a notice of cancellation specifying the date from which the User no longer wishes to receive the philatelic products.
8.12 The recipient who is a natural person has the right to return the philatelic products and receive a refund for the cost of the philatelic products within 14 days as of the receipt of the philatelic products. The handling fee shall not be refunded unless the Subscriber returned the products due to the fact that POST incorrectly executed the order.
8.13 The recipient who is a legal person has the right to return the philatelic products within 7 days as of the receipt of the philatelic products and receive a refund for the order amount if POST incorrectly executed the Order, inter alia, the delivered philatelic products do not comply with the ordered products in terms of quantity, quality, or assortment.
8.14 To return the philatelic products, the Subscriber shall submit a written application to POST specifying the contact information of the Subscriber specified in clause 6.2, the contact information of the recipient specified in clause 6.2, a description of the Order, the information for payment of the order amount (date of payment, amount, bank), and the products to be returned. If possible, we ask that the Recipient specify the reason for the return. The products to be returned and the application for returning the products shall be sent by the Subscriber at the following address: Eesti Postmark, Pallasti 28, 19098 Tallinn.
8.15 POST has the right to take back the products and not to refund the cost thereof if the returned product is damaged.

9. Ordering of numismatic/bonistic products
9.1 Upon submission of the Order, the User shall choose the products to be purchased; in the case of a domestic order, a registered item or courier item may be chosen as the manner of delivery.
9.2 The order amount of the Order comprises the cost of the ordered products, the handling and delivery fees and, in case of an order with the cost of over 35,00 €, a valuation.
9.3 For all orders, the amount of handling fee shall be 0,80 € per 250 grams of each order.
9.4 The price list of delivery fees shall be based on the price list for the mail services of POST, the price list for parcel services, and the price list for courier services.
9.5 The price list for domestic mail services, the price list for international mail services, the price list for domestic parcel services, the price list for international parcel services, the conditions for receipt of international insured products.
9.6 A domestic order with a weight of up to 2,000 grams and with a value of up to 35,00 € shall be delivered as a registered maxi letter; with a value of over 35,00 € as an insured maxi letter, plus the valuation of the cost for the ordered products at the rate of 1 % of the purchase amount.
9.7 A domestic order with a weight of over 2,000 grams and with a value of up to 35,00 € shall be delivered as a registered standard parcel and if the value is over 35,00 €, plus the valuation of the cost for the ordered products at the rate of 0.5 % of the purchase amount.
9.8 A domestic order as a courier parcel shall be delivered as a service of ELS Pluss, plus the valuation of the cost for the ordered products at the rate of 1 % of the purchase amount.
9.9 An international order with a weight of up to 2,000 grams and with a value of up to 35,00 € shall be delivered as a priority registered maxi letter, with a value of over 35,00 € as a priority insured product accounting for the conditions for acceptance of insured letters and insured parcels applicable in the destination country, plus the valuation of the cost for the ordered products at the rate of 10% of the purchase amount for letter consignments and 5% for parcel consignments.
9.10 The maximum weight of an order shall be 20,000 grams, the maximum value of a domestic order shall be 4 505,00 €. In the case of an international order, the maximum weight and value are according to the conditions for acceptance of insured letters and insured parcels applicable in the destination country.
9.11 The Order shall enter into force as of the time when the order amount is credited to the bank account of POST.
9.12 The time period for execution of the Order, i.e. for delivery of the products to the recipient in Estonia shall not be more than 4 working days as of entry into force of the Order. If the Order cannot be carried out within 4 working days, the Subscriber shall be notified thereof through the communication channel given upon submission of the Order.
9.13 The recipient who is a natural person has the right to return the products and receive a refund for the cost of the products within 14 days as of the receipt of the products. The handling fee shall not be refunded unless the Subscriber returned the products due to the fact that POST incorrectly executed the order.
9.14 The recipient who is a legal person has the right to return the products within 7 days as of receipt of the products and receive a refund for the order amount if POST has incorrectly carried out the Order, inter alia, the delivered products do not comply with the ordered products in terms of quantity, quality, or assortment.
9.15 To return the products, the Subscriber shall submit a written application to POST specifying the contact information of the Subscriber specified in clause 6.2, a description of the Order, the information for payment of the order amount (date of payment, amount, bank), and the products to be returned. If possible, we ask that the Recipient specify the reason for the return. The products to be returned and the application for returning the products shall be sent by the Subscriber at the following address: Eesti Postmark, Pallasti 28, 19098 Tallinn.
9.16 POST has the right to take back the products and not to refund the cost thereof if the returned product is damaged.

10. Protection of intellectual ownership
10.1 The contents of the E-environment, including its text, graphics, logos, icons of buttons, pictures, copyrights to audio, and software shall belong to POST or the person who has created them, and they shall be protected by the legislation regulating the protection of intellectual ownership.
10.2 The E-environment shall be in the ownership of POST and shall be protected by the Copyright Act of the Republic of Estonia.
10.3 It is not permitted to copy, multiply, resell, or otherwise use for any commercial purposes the order and enquiry forms as well as the data of the E-environment. The E-environment may be used for the intended legitimate activities.
10.4 Any copying, modification, distribution, forwarding, publication, or exhibition of the E-environment is not justified, is in conflict with the Copyright Act and other legislation on the protection of the intellectual ownership rights and shall bring about liability in accordance with the aforementioned legislation.
10.5 Upon violation of the Conditions by the User, POST may refuse to provide the User with the Service specified in the Conditions.

11. Final provisions
11.1 Any disputes concerning these Conditions shall be resolved by way of negotiations. To protect his or her interests, the User may turn to the Estonian Competition Authority or a court pursuant to the procedure provided by the legislation of the Republic of Estonia.
